abstract = {Since our government is ideological, the laws must be based on religious rules and the infallibles` lifestyle. One of the primary sources for taking pattern on, is Imam Ali`s (peace be upon him) governorship. Studying his governorship shows that he never consented on neglecting the ideals, principles and religious rules, even if it meant undermining the power and ruling. Research in the sections on "conflict" or "secondary rules" indicates that based on the known rules on jurisprudence, to preserve a government, sometimes neglecting a religious rule, is legal. In such a case, the primary rule must not be emphasized. Such an insistence, is not only a sign of piety, but also is rationally and religiously discouraged. Having this fact in mind, the ideal behavior of Imam Ali (peace be upon him) is not adaptable to the known jurisprudent rules. This paper seeks to examine each of these samples so that it shows that Imam Ali`s (peace be upon him) behavior were completely adapted with jurisprudent rules and they can be examined in the same manner},

abstract_fa ={ازآنجاکه جمهوری اسلامی ایران مبتنی بر ارزش های اسلامی است، قوانین حکومتی باید بر اساس ضوابط شرعی و بر مبنای سیره معصومان علیهم السلام تدوین شوند. یکی از منابع اصلی برای الگوبرداری، سیره حکومتی امیر مؤمنان علیه السلام می باشد، مطالعه سیره حکومتی ایشان، نشان می دهد که حضرت به هیچ وجه حاضر به نادیده گرفتن ایده آل ها، احکام و قوانین شریعت نبوده اند، حتی اگر منجر به تضعیف قدرت و حکومت شود. اما تتبع در ابواب فقهی مثل «باب تزاحم» یا «احکام ثانویه»، نشان می دهد که طبق ضوابط شناخته شده‌ی فقهی، گاهی برای حفظ حکومت، ترک یک حکم شرعی، مجاز، قلمداد می شود. با توجه به این نکته، رفتار آرمانی امیر مؤمنان علیه السلام، با ضوابط فقهی چگونه قابل توجیه است. هدف این مقاله، این است که با بررسی تک تک این نمونه ها نشان دهد که رفتارهای حضرت تعارضی با ضوابط فقهی نداشته و بر همان اساس، قابل تحلیل می باشد.},
