The “Conceptual Reason” and “Common Sense” have been exercising a pivotal role in the amendment and enforcement of the human rights on the basis of the modern world’s worldview. According to the social philosophy of the modernity, the special euphemisms and terminology have been accompanying human rights, as follow: 1- Individual and individualism (psychological man, freewill, and power) 2- Rationalism and scientism (scientific worldview, world-building, and secularization) 3- The rule of law and citizenship (liberalism, global community, and the paradox of democracy). Overall, it seems that the human rights are as a sacred text of the modern man actually attached with the abstract destitute subject_ mainly functioning under the “Instrumental Reason” of the western political system این مقاله تلاش می کند تا با تحلیل تبارشناسی، پیدایش «حقوق بشر» را در دورنمایی از بستر و بنیان های هستی شناسی و انسان شناسی دنیای مدرن ترسیم کند؛ بشری که از «سوژۀ» عصر روشنگری و رنسانس حرکت را آغاز کرد و به سمت «فرد» و سپس، «شهروند» سیر کرده است. «عقل مفهومی» و «عقل عُرفی» در تنقیح و تقنین حقوق بشر، بر مبانی جهان بینی دنیای مدرن نقشی کلیدی ایفا کرده اند. بر اساس فلسفۀ اجتماعی مدرنیته، ترمینولوژی و حُسن تعبیرهایی خاص، پیوستگی و ملازمت با حقوق بشر را بر عهده داشته اند که عبارتند از: 1. فرد و فردگرایی 2- خِرَدگرایی و علم گرایی 3. حکومت قانون و شهروندی. در مجموع، به نظر می رسد حقوق بشر به منزلۀ متن مقدس انسان مدرنی است که در حقیقت، با سوژه ای انتزاعی و تهی پیوند یافته و عمدتاً ذیل «عقل ابزاری» نظام سیاسی غرب عمل می کند. https://siyasi.nashriyat.ir/sites/siyasi.nashriyat.ir/files/article-files/7_5.pdf
