abstract = {The governance of cyberspace is one of the newly added topics to the political science and law. The governance of existing cyberspace, which is organized in the bed of the global internet, is one of the most challenging issues of the contemporary world. The religious nature of the Islamic Republic of Iran requires that, to propose the duties of the Islamic government in the management of cyberspace with regard to the foundations of Islamic jurisprudence. The principles of the constitution, derived from the dynamic Islamic jurisprudence, indicate that the Islamic Republic system has duties; such as: denial of domination, rejection of colonialism totally, prevention of the penetration of aliens, providing the conditions for self-sufficiency in the fields of science, technology and industry and creating suitable conditions for the growth of moral virtues. Using a descriptive-analytical and Ijtehadi method, and given the dominance of the aliens on cyberspace in two platforms of structure and content, this paper seeks to study the important duties of the Islamic Republic system towards this new phenomenon such as, creating the national information network, establishing the system of Imamate and the Ummah through co-operation with other Islamic countries, under the light of the juridical rule of "nafy al-sabil" (denying the domination of unbelievers over believers) and the constitutional principles of the Islamic Republic of Iran.

abstract_fa ={«حکم رانی فضای مجازی» از موضوعاتی است که به تازگی در علم سیاست و حقوق وارد شده است. حکم رانی فضایِ مجازیِ موجود، که در بستر اینترنت جهانی سامان یافته، یکی از مباحث پرچالش دنیای معاصر است. سرشت مکتبی نظام جمهوری اسلامی ایران می طلبد تا با نظر به شالوده های فقه اسلام، وظایف حکومت اسلامی در حکم رانی فضای مجازی ترسیم گردد. اصول قانون اساسی، برگرفته از فقه پویای اسلام، حاکی از آن است که نظام جمهوری اسلامی وظایفی برعهده دارد؛ همچون: نفی هرگونه سلطه پذیری، طرد کامل استعمار و جلوگیری از نفوذ بیگانگان، تأمین خودکفایی در زمینه‌ی علوم و فنون و صنعت، و ایجاد محیط مناسب برای رویش فضایل اخلاقی. این پژوهش با روش «توصیفی ـ تحلیلی« و «اجتهادی» در مقام تبیین آن است که با توجه به چیرگی بیگانگان بر فضای مجازی اینترنت محور، که در دو بستر «ساختار» و «محتوا» ترسیم می شود، قاعده‌ی «نفی سبیل» که در فقه اسلام و اصول قانون اساسی جمهوری اسلامی ایران بازتاب یافته است، تکالیف گرانی را بر دوش نظام جمهوری اسلامی در مواجهه با این پدیده‌ی نوظهور می گذارد که از جمله‌ی آنها، آفرینش شبکه‌ی ملّی اطلاعات و پی ریزی نظام امامت و امّت از راه هم افزایی با دیگر کشورهای اسلامی است.},
