abstract = {Despite the order of the Holy Quran to the Prophet (PBUH & HH) to consult in political-social affairs and some narrations about the Prophet's consultation conduct, it is possible to explain the approach of the Islamic government in matters based on consultation and the degree of validity of the majority vote. Evaluating the implication and issuance of political-social consultations of the Prophet (PBUH & HH) with a jurisprudential approach, this research, while accepting consultation in the religious governance method, frees the Islamic government from being in the strait of following the majority opinion and considers the decision to be based on the consideration of conditions and benefits. Therefore, while explaining the "nature of consultation" and discarding some of the cases mentioned in the number of the Prophet's consultations, in the end, fourteen items from among the consultations of the Holy Prophet (PBUH & HH) under "Consultation in military affairs" and "Consultation in social affairs" have been evaluated for issuance and implication. In addition to examining the document, the method of collecting evidence was also used in the issuance validation, and in the evaluation of the significance of these consultations, while analyzing the realization of the majority vote, the extent of their implication on the validity or invalidity of the majority vote was taken into consideration, and their lack of implication on the validity of the majority vote was taken into account. },

abstract_fa ={به رغم دستور قرآن کریم به پیامبر برای مشورت در امور سیاسی ـ اجتماعی و نقل برخی موارد از سیره مشورتی پیامبر(ص) می توان رویکرد دولت اسلامی در امور منوط به مشورت و میزان اعتبار رأی اکثریت در این امور را تبیین نمود. این پژوهش با ارزیابی فقهی دلالی و صدوری مشورت های پیامبر(ص) ضمن پذیرش مشورت در شیوه حکمرانی دینی، حکومت اسلامی را از قرار گرفتن در تنگنای لزوم تبعیت از رأی اکثریت خارج نموده تا با ملاحظه شرایط و مصالح بتواند تصمیم  نهایی را اتخاذ نماید. ازاین رو ضمن تبیین «ماهیت مشورت» کنار گذاشتن برخی موارد ذکرشده در شمار مشورت های پیامبر(ص) در نهایت چهارده مورد از مشورت های ایشان در ذیل «مشورت در امور نظامی» و «مشورت در امور اجتماعی» مورد ارزیابی صدوری و دلالی قرار گرفته اند که در اعتبارسنجی صدوری علاوه بر بررسی سند از شیوه تجمیع قرائن نیز بهره جسته شد و در ارزیابی دلالت نیز این مشورت ها ضمن تحلیل تحقق رأی اکثریت، میزان دلالت آنها بر اعتبار یا عدم اعتبار رأی اکثریت مورد توجه قرار گرفت و عدم دلالت آنها بر اعتبار رأی اکثریت تبیین گردید.},
