abstract = {"Political Legitimacy" as the most important issue of the political discourse of Islam, has allocated a huge volume of political discussions of Islamic theologians. The theory of "choice" in various forms is considered one of the most important views of legitimacy in Sunni political discourse. One of these formats is "the choice of the people of Hal and Aqd"; In the sense that when a person is elected by - even - one of the people of Hal and Aqd, his Imamate and government will be legitimate. The basic question is, who do Sunni theologians consider as "the people of Hal and Aqd"? How many people are necessary for the truth of this concept? What are their evidences for proving legitimacy through the people of Hal and Aqd? Are their criteria and arguments defensible? Using the descriptive-analytical method as well as the "rational" and "narrative" method and by using authentic theological, hadith and historical sources of Sunnis, this article has analyzed the aforementioned issues. The results show that their original point of view and arguments are faced with fundamental problems and cannot be defended even based on their own sources.  },

abstract_fa ={«مشروعیت سیاسی» به منزله مهم ترین مسئله کلام سیاسی اسلام، حجم عظیمی از مباحث سیاسی متکلمان اسلامی را به خود اختصاص داده است. نظریه «انتخاب» با قالب های گوناگون، یکی از مهم ترین دیدگاه های مشروعیت در کلام سیاسی اهل سنت به شمار می رود. یکی از این قالب ها «انتخاب اهل حلّ و عقد» است؛ به این معنا که وقتی شخصی از سوی ـ حتی ـ یک تن از اهل حل و عقد انتخاب گردد، امامت و حکومت وی دارای مشروعیت خواهد بود. سؤالات اساسی این است که متکلمان اهل  سنت چه کسانی را «اهل حلّ و عقد» می دانند؟ چه تعدادی از افراد برای صدق این مفهوم لازم است؟ ادله ایشان بر اثبات مشروعیت از طریق اهل حل و عقد چیست؟ آیا ملاک ها و ادله ایشان قابل دفاع است؟ این مقاله که با رویکرد توصیفی ـ تحلیلی و روش «عقلی» و «نقلی» و با استفاده از منابع معتبر کلامی، حدیثی و تاریخی اهل  سنت تدوین شده، به تحلیل مسائل مزبور پرداخته و به این نتیجه رسیده که اصل دیدگاه و ادله ایشان با اشکالاتی اساسی مواجه است و حتی براساس منابع خودشان نیز قابل دفاع نیست.},
