By "guardianship" we mean the presidency and authority of a person who is capable of extracting and inferring Islamic rules and laws from Islamic sources. The present paper tries to offer an approach to a new framework by which the transmitted evidence in are explored, thus paving the way for using other neglected evidence. To this end, the main concern of this paper is to examine the typology of the evidence in the transmitted sciences on the guardianship of religious jurist. The evidence is of three types: negative evidence that prohibits referring to and establishing relations with conventional governments in different levels; positive evidence through which those who are suited and are granted God's permission to rule are known; and finally collated evidence which refers to the narrations in which the message of either of two previous sides is presented. بررسی ادله نقلی ولایت فقیه، یکی از موضوعات اساسی در باب نظریه ولایت فقیه است. منظور از «ولایت فقیه» در این نظریه، ریاست و زمامداری فردی است که می­تواند با مراجعه به منابع اسلامی، احکام و قوانین اسلامی را استخراج و استنباط نماید. با توجه به اهمیت موضوع، این مقاله، با رویکرد تحلیلی و نظری، به گونه­شناسی ادله‌ی نقلی ولایت فقیه می پردازد؛ گونه­های مختلفی که می­تواند در اثبات ولایت فقیه به کار آید، ازاین رو، به سه گونه از ادله نقلی در این زمینه می­توان اشاره کرد: ادله‌ی سلبی. یعنی ادله­ای که در آنها از رجوع حکومت­ها عرفی و داشتن ارتباط با آنها در سطوح مختلف، نهی شده است. ادله ایجابی؛ یعنی ادله­ای که در آنها شایستگان برای حکومت و مأذون از ناحیه خداوند مشخص شده­اند. در نهایت، ادله تلفیقی؛ روایت­هایی که در آنها رسالت هر دو دسته قبلی با هم مطرح شده است. در این روایت­ها، ابتداء به نوعی مشروعیت سلاطین عرفی نفی شده و در ادامه به جایگاه فقهاء اشاره می­شود که بیانگر مشروعیت سیاسی آنها می­باشد. https://siyasi.nashriyat.ir/sites/siyasi.nashriyat.ir/files/article-files/3_2.pdf
